This Terms of Service Agreement (the "Agreement") is entered into by and between GraviDAO ("we" or "us") and you ("you" or "user"), the user of the Lunar Assistant Discord bot (the "Bot").

By accessing or using the Bot, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, do not use the Bot.

1. Description of the Bot

   The Bot is a software program that runs on the Discord platform and provides token gating functionality and role management to users.

2. Use of the Bot

   You may use the Bot for personal or non-commercial purposes only. You may not use the Bot for any illegal or unauthorized purpose.

3. Limitations on Use

   • You agree not to copy, modify, distribute, sell, or lease any part of the Bot or the software used to operate the Bot, except as expressly authorized by us in writing.
   • You agree not to reverse engineer, decompile, or disassemble the Bot or any part of it.
   • You agree not to use the Bot in any way that could damage, disable, overburden, or impair our servers or networks.

4. Intellectual Property

   • The Bot, including all software, graphics, images, and other materials used to operate the Bot, are the property of GraviDAO and are protected by intellectual property laws.
   • You may not use any of our trademarks, logos, or other proprietary information without our prior written consent.

5. Disclaimer of Warranties

   • THE BOT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE BOT, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO YOU AND THE RESULTS OBTAINED THROUGH THE BOT. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES, AND 2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
   • THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.

6. Limitation of Liability

   IN NO EVENT SHALL GraviDAO OR ANY OF ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE BOT, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

7. Indemnification

   You agree to defend, indemnify, and hold harmless GraviDAO and its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Bot; (ii) your violation of any term of this Agreement; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

8. Termination

   We may terminate this Agreement at any time, with or without cause, and with or without notice. Upon termination, you must immediately cease all use of the Bot.

9. Changes to the Agreement

   We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10. Governing Law

    This Agreement and any disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the laws of the state of [Your State], without regard to its conflict of law provisions.

11. Entire Agreement

    This Agreement constitutes the entire agreement between you and GraviDAO regarding the use of the Bot and supersedes all prior agreements and understandings, whether written or oral, regarding the use of the Bot.
